daughter escaped without injuries. she is due to give birth today but her husband is in critical condition >> everybody needs to pray for them >> a police department released a booking photo this afternoon and a lawyer representing the suspect's parents told reporters their hearts go out to the victims and their families. >> family has elected not to discuss james or their relationship with james at this time >> security was tight when the suspect faced the judge today. police station snipers on the courthouse roof. holmes is being kept in solitary confinement. when it is all done there could be hundreds of charges. in addition to first-degree murder, it could turn into a death penalty case and there could be domestic terrorism charges. the next court appearance is one week from today when you will be formally arraigned.

been anti-war protesters and those trying to show support for the dream act. if you live or work in the oakland uptown district be ready for a long ride home. there will be restrictions around the fox theater until at least 10:00 tonight and ac bus transit service will be rerouted around that area until 11:00. >> mitt romney was busy with three fund-raisers in the bay area yesterday. private events in woodside and pacific heights were $50,000 per plate. the former massachusetts governor and left this morning for southern california where he met with small business owners in costa mesa. it is his third trip to orange county since march. he has raised $14 million for orange county this year. >> stocks slid for the second trading day amid fears that spain may need a bailout. the dow fell and the broader

>> san jose police are looking for the killer of young couple inside their home. neighbors on the 300 block of seventh street say they heard shouting and shops around 4:00 this morning and saw a man running from the home. they say victim were a couple in their 20s who had three small children. one woman said one of the children may have seen the shooting. >> my concern was the kids because they were coming out crying and i ask them what

happened in they said the man shot my mommy and daddy >> police say they don't believe it was a murder-suicide and are investigating it as a double murder. >> 84 alarm fire leave 60 people in san jose homeless. fire, it started on camden avenue around 9:00 last night. 20 apartments were damaged and five people suffered minor injuries. the cause is being investigated. raiders wide receiver. spay pleaded no contest to a the y charge. chp says it's spotted him leaving on the lower deck of the bay bridge in april. he failed to sobriety tests. an oakland police officer was injured early this morning after crashing into a car and then into this building. it happened at h&r block. the officer was taken to the hospital but has been released.

sacramento valley last night. firefighters this morning believe it was a lightning strike that started a small grass fire off of auburn boulevard in sacramento. it was quickly extinguished. there was rainfall in the sacramento valley. we're calling on doppler radar and nothing is going on right now but if we do see a reoccurrence, you will be the first to know with high- definition doppler radar. this is a live cbs five weather camera looking at the development of the marine layer. it is a breezy evening throughout the tri valley. the wind it southwest at 13. the forecast, official sundown had 825.
